A privacy-oriented email service, Proton Mail, provided payment information about a subscriber to Swiss law enforcement, which subsequently reached the FBI.

Court documents obtained by 404 Media reveal that this data assisted federal agents in tracing the person allegedly managing an anonymous email address connected to Atlanta's "Stop Cop City" activism.

The Stop Cop City campaign arose after Atlanta authorities announced intentions to construct a substantial police and firefighter training facility in a wooded region near the city. Opponents responded with demonstrations, legal action, and forest occupations to block the development. Federal and local agencies have pursued investigations into alleged criminal activities including property destruction, arson, and releasing private information.

An FBI agent's sworn statement in support of a search warrant indicated that investigators secured subscriber details for the Proton Mail address defendtheatlantaforest@protonmail.com via a mutual legal assistance treaty (MLAT) submission to Swiss officials.

The filing reveals that Swiss authorities delivered information on January 25, 2024, identifying a particular person as the payment source behind the Proton Mail account, which investigators connected to the Defend the Atlanta Forest (DTAF) organization and the wider Stop Cop City resistance.

The email address reportedly served as the main contact on the Defend the Atlanta Forest Facebook page and was featured on a blog that promoted demonstrations and activities opposing the training center's construction near Intrenchment Creek Park in Atlanta.

The affidavit states that authorities suspected the individual managing the Proton Mail account likely possessed administrative control over the group's blog, which shared information about protests and actions directed at contractors and infrastructure associated with the development.

The FBI document referenced in the reporting was prepared by a special agent from a domestic terrorism unit and shows investigators intended to conduct a search warrant operation at Atlanta's airport after learning the suspect's travel schedule.

Edward Shone, head of communications at Proton AG, told 404 Media that the company did not supply information directly to the FBI but rather responded to a legally enforceable directive from Swiss authorities, who then transmitted the material via the MLAT framework.

Shone stressed that Proton functions under Swiss legal authority and releases restricted data only after Swiss courts authorize a request.

He noted that Proton processes payments via credit cards, cryptocurrency, or cash, and that credit card payments contain payment identifiers enabling investigators to trace the cardholder through the card-issuing financial institution.

The company stated that the request underwent evaluation according to Swiss legal criteria concerning serious criminal accusations before information was disclosed.

This incident highlights the enduring difference between encrypted message content and account-related metadata. Although Proton Mail cannot view users' encrypted messages, it may retain minimal information including account registration data, payment identifiers, and voluntary recovery details.

Comparable issues emerged in earlier incidents involving Proton Mail, such as a 2024 situation where the platform faced criticism for providing IP logs, recovery email addresses, and external service information to Spanish authorities, resulting in the identification of a Democratic Tsunami member, a Catalan independence group.
